Terms of Service
These terms govern your use of Pisto (pisto.com.au). "We" and "us" mean the operator of pisto.com.au. By using the site you agree to them.
What Pisto is
You tell us about someone you're buying a gift for, and we return product and experience suggestions drawn from our catalogue, third-party retailers and booking platforms, with automatically generated reasoning for each one — including, in some cases, reasoning generated by third-party language-model providers. Pisto does not sell products or experiences. When you buy or book something, you do it with the retailer or booking platform whose link you clicked.
No guarantee on suggestions, pricing, or availability
- Suggestions are generated automatically and may be wrong, mismatched, or simply not what you were hoping for. Use your own judgment before buying.
- Prices, stock, and product details are set by the retailer or, on a marketplace, by the independent seller, not by us, and can change without notice. The price shown here may not be the price you're charged — always confirm it on the retailer's own site before buying.
- We don't guarantee the service will be available, uninterrupted, or error-free, or that any particular product, retailer, or price stays in our catalogue.
Purchases and bookings are with the provider, not with us
When you click through to buy or book, you leave Pisto and deal directly with that retailer or booking platform, and for an experience, with the business that runs it. On a marketplace, you may be buying from an independent seller rather than from the marketplace itself, and that seller's own policies apply. Any resulting contract — payment, delivery, bookings, cancellations, returns, warranties, and customer service — is between you and them. We are not a party to it. Accounts
You must be 16 or older to create an account. Keep your email account secure: anyone who can read your sign-in codes can get into your Pisto account.
Your account holds what you tell us about the people you shop for. Only add details you're entitled to share and that choosing a gift needs, nothing sensitive such as health information, and don't use Pisto to keep information about anyone for any other purpose.
You can delete your account at any time from your account page. We may suspend or delete an account that breaches these terms. If we stop offering accounts, we'll post notice on the site in advance so you can download your data first.
Acceptable use
You agree not to:
- Use the service for any unlawful purpose, or submit content you don't have the right to submit.
- Circumvent technical restrictions, access the service by automated means, or interfere with its normal operation. The one exception is an AI assistant using the search service we provide for that purpose, on the terms under "AI assistants" below.
- Misuse the outbound links, including artificially generating clicks.
- Copy, store, or republish our results, use them to train or evaluate AI models, or build another catalogue or index from them.
We may limit, suspend, or end access for use that breaches these terms.
AI assistants
An AI assistant can search Pisto on someone's behalf through the search service we provide for assistants. The person or company running the assistant accepts these terms by using it, without a key, within the daily allowance.
- What you get. Gift ideas, each with a reason and a Pisto link. The service returns no products, prices or shop links; those are shown on Pisto.
- What you may do. Search for a person who asked your assistant for a gift idea; show that person the gift ideas and reasons, and keep them in that person's own conversation history; send them to the Pisto links we return.
- Attribution. Say the gift ideas come from Pisto, show each with its Pisto link unchanged (no replaced links, and no added affiliate or tracking parameters), and pass on that Pisto may earn a commission on purchases made through its links.
- Don't. Store results anywhere other than that person's conversation, republish them, use them to train or evaluate models, or build a catalogue, index or comparison service from them. Search in bulk or systematically (for example stepping through every person, occasion and budget). Rotate addresses or identities, or split use across clients, to get more requests than the allowance gives you. Send names, contact details or other personal information in the note.
- Free, within a daily allowance. The allowance may change or end. When it is used up, or we are busy, the reply includes a Pisto search link to hand the person to.
- Our side. To protect the service and its running costs we may refuse, limit or stop requests, and we do not guarantee the service will be available. We will give notice of material changes to these terms by updating the date above. Results are gift ideas, not advice; prices and stock are shown on Pisto and the retailer's site and may change.
Intellectual property
The Pisto name, logo, and site design belong to us. Product names, images, and descriptions belong to their retailers, sellers or brand owners and are used to help you identify products, not claimed as ours.
Limitation of liability
To the maximum extent permitted by law, Pisto is provided "as is" without warranties of any kind, and we are not liable for any indirect, incidental, or consequential loss arising from your use of the service, including loss arising from a suggestion, price, or availability turning out to be wrong, or from a purchase made with a third-party retailer.
This does not exclude your Australian Consumer Law rights. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted, or modified. Where our liability can be limited rather than excluded, it is limited to the extent the law allows.
Changes to the service and these terms
We may change or discontinue features, and may update these terms from time to time. We'll update the date at the top when we do. Continued use after a change means you accept the updated terms. You can stop using Pisto at any time.
Governing law, and how to reach us
These terms are governed by the law of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state. For anything about these terms, email hello@pisto.com.au.
